On May 25, 2005, Martinez was pushing a basket of bottles or cans near the corner of Ralston and Johnson in Ventura. Alfred Leon offered him some food. Martinez hit Leon on the head with a bottle. Leon called the police who arrested Martinez.
While Martinez was in jail, he was placed in the same cell as Luis Rios. Sheriff’s deputies noticed that Martinez was hunched over Rios. When the deputies went into the cell, they saw that Martinez was choking him. The deputies pulled Martinez off Rios. Rios was visibly shaken and had a mark on his neck.
On May 25, 2005, around 5:20 a.m., John Perez was driving along an alley on his way home in Oxnard. Perez noticed a body lying in the dirt, and called the police. The victim, Lorena Gonzalez, had been strangled. Her tank top and bra had been pushed up, exposing her breasts. Video surveillance cameras showed Gonzalez leaving an apartment with Martinez at 12:47 a.m. on May 25, 2005.
Between May 26 and June 13, 2005, the police interviewed Martinez four times. Each time the police advised him of his Miranda rights, and he agreed to waive his rights and talk to the police. The interviews were either audiotaped or videotaped. During the interviews, Martinez admitted that he asked Gonzalez to have sex with him but she refused. He strangled her into unconsciousness and removed her pants. He had sex with her before she died. While taking off her clothes, he was thinking he was going to murder her.
